Terms of Service

Short version: Amy sends marketing on your behalf, so you promise the list is yours and consented; we promise the compliance machinery runs before every single send. Amy is billed through Shopify: $10 a month plus what you send. Cancel by uninstalling Amy.

1. The service

Amy (“the Service”, operated by Hire Amy) is an email and SMS lifecycle-marketing application for Shopify stores. Amy drafts messages with AI, runs automations you enable, and sends campaigns you approve. By installing Amy (Shopify OAuth) you agree to these terms on behalf of your business.

2. Your account

  • You must have the authority to bind the store that installs Amy.
  • Access is granted through Shopify OAuth; you can revoke it at any time by uninstalling.
  • You’re responsible for the accuracy of your brand settings — Amy writes and sends as your brand.

3. Billing

  • Amy has one plan. Amy is billed through Shopify: $10 a month plus what you send. Shopify holds your payment details; we never see them.
  • Cancel by uninstalling Amy. Charges follow Shopify’s billing cycle.
  • If your subscription lapses, sending stops. Your data isn’t deleted by a lapse — see the Privacy Policy for deletion.

4. Acceptable use — the consent promise

This is the clause that matters most. You agree that:

  • Every contact you import or collect gave real marketing consent to your store. No purchased, rented, or scraped lists — ever.
  • You will not attempt to circumvent Amy’s compliance machinery: consent checks, one-click unsubscribe, SMS quiet hours, suppression lists, and sending-volume warm-up run before every send and are not optional.
  • Your message content must be lawful, non-deceptive, and yours to send. Amy’s AI drafts are suggestions; you approve what sends, and you own responsibility for the approved content.
  • Regulated-content rules for your industry are yours to know and follow.

We may suspend sending — or the account — for spam complaints, list abuse, or attempts to message people who opted out. That protection exists for every merchant on the platform, including you.

5. Your data

Your store’s data stays yours. How it’s collected, protected, and deleted is covered by the Privacy Policy, which is part of these terms. We never use your store’s or your customers’ data to train or improve AI models. We use service metrics such as uptime and error rates to keep Amy running.

6. The AI

Amy uses AI to draft copy and recommend campaigns. Drafts can be imperfect; that’s why nothing sends without your approval. We don’t guarantee any particular open rate, click rate, revenue, or deliverability outcome — inboxes and carriers make their own decisions.

7. Availability & changes

We aim to keep Amy running continuously but the Service is provided “as is” without warranties of uninterrupted availability. We may improve or change features over time; if a change materially reduces the Service, you can cancel without penalty.

8. Liability

To the maximum extent the law allows: neither party is liable for indirect or consequential damages, and Hire Amy’s total liability for any claim is capped at the subscription fees you paid in the three months before the claim. Nothing here limits liability that cannot lawfully be limited.

9. Termination

Uninstalling ends the agreement — sending stops immediately and store access is revoked. Sections that by nature survive (consent-record retention, liability, disputes) survive.
